Governance of IoT Data: Why the EU Data Act Will not Fulfill Its Objectives

Abstract The EU Data Act proposal (DA) seeks to introduce new rights for the users of internet things (IoT) devices regarding access, use and sharing data generated through their these devices. This paper presents results a first analysis effectiveness this ‘user rights’ mechanism from ‘law economics’ perspective. It concludes that DA will not achieve its objectives (a) empowering IoT (especially consumers), (b) unlocking large amounts innovation (for IoT-related services across sectors), (c) contributing fair value data. Although correctly identifies main problem arising manufacturers’ technical design devices, which grants them exclusive de facto control over data, proposals solving it are close being sufficient: (1) proposed user suffers manifold serious problems make weak largely ineffective (insufficient scope data; lacking interoperability; high transaction costs, especially need negotiated contract with FRAND conditions; unclarity markets). (2) Also, option gain more operates requirement holders can only on basis users, work due unsolved market failure in B2C situations.
